Welcome to Secondwind Marketing. By accessing this website or purchasing our services, you agree to be bound by the following Terms & Conditions. Please read them carefully.

1. About Us

Secondwind Marketing is a marketing agency located at Nedumkandam, Idukki, Kerala – 685553, India, offering animation, video production, advertisement creatives, social media marketing, performance advertising and branding services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use our services.

3. Services & Orders

The scope, deliverables, timelines and price of each service are as described on our website or in the written quotation / proposal shared with you. Work begins after the order is confirmed and payment (or the agreed advance) is received.

4. Pricing & Payment

• All prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes unless stated otherwise.
• Payments can be made online through our secure payment gateway using credit/debit cards, net banking, UPI, wallets or other available modes.
• We reserve the right to change prices at any time; changes will not affect orders already confirmed and paid.
• We are not responsible for any failure or delay of payment caused by the payment gateway, your bank or any intermediary. If an amount is debited but the order is not confirmed, it will be reversed as per the bank / gateway timelines.

5. Client Responsibilities

You agree to provide accurate information, timely feedback and all required material (logos, images, footage, text, approvals). Delays in providing these may extend delivery timelines. You confirm that you own or have the rights to all material you provide to us.

6. Revisions

Each package includes the number of revision rounds stated in it. Additional revisions or changes outside the agreed scope will be charged separately.

7. Intellectual Property

On receipt of full payment, ownership of the final approved deliverables is transferred to you. Drafts, raw files and project source files remain with Secondwind Marketing unless agreed otherwise in writing. We may showcase completed work in our portfolio unless you request otherwise in writing.

8. Advertising Results

We work to achieve the best possible results, but we do not guarantee specific sales, leads, views, followers or return on ad spend. Ad spend paid to third-party platforms (Meta, Google, YouTube etc.) is separate from our service fee and is governed by those platforms' policies.

9. Refunds & Cancellation

Refunds and cancellations are governed by our Refund & Cancellation Policy.

10. Prohibited Use

You may not use our services or website for any unlawful, fraudulent, defamatory, obscene or infringing purpose. We may refuse or stop work on any project that violates these terms or applicable law.

11. Limitation of Liability

To the maximum extent permitted by law, Secondwind Marketing shall not be liable for any indirect, incidental or consequential damages. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

12. Indemnity

You agree to indemnify Secondwind Marketing against any claims arising from material you provide or your breach of these terms.

13. Governing Law & Jurisdiction

These terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Idukki, Kerala.

14. Changes to Terms

We may modify these Terms & Conditions at any time. Continued use of the website or our services after changes means you accept the revised terms.
